MINOR CHILD’S LIBRARY RECORDS

Public Act 188 1996 amends the Michigan Library Privacy Act. The Act now permits disclosure of library records if the library receives “written consent of the person liable for payment for or the return of the materials identified in that library record.” MLC397.603.2.

The Ypsilanti District Library accepts the philosophical position that a parent or guardian who signs the consent form becomes liable for the loaned materials only upon the default of the patron named in the record. This means that the parent or guardian is not contacted unless the patron fails to return library materials on time and the library record is not revealed to the liable parent or guardian until or if the patron named in the record does not return the materials on time.
